Brief answers

  • Private landlords advertise on portals with a private-landlord filter, classified advertisements, notices and neighbourhood networks. You pay an agent's commission only if you commissioned the agent yourself (Bestellerprinzip, § 2(1a) WoVermittG).
  • The deposit may not exceed three net rents; you can pay them in three monthly installments (§ 551 BGB).
  • The rent cap also applies to private landlords. Check the rent against the rent index - and never pay money before you have seen the apartment and signed the contract.

01Renting privately: What’s the real point?

The most important advantage is direct contact. Private landlords often decide for themselves and based on their personal impressions, not based on a points scheme. Anyone who presents themselves well has opportunities, even if they don't have the highest income.

No commission – but not with brokers either: Since June 2015, the commissioning-party-pays principle has applied to residential letting (§ 2(1a) Housing Brokerage Act): whoever appoints the agent pays, usually the landlord. Renting privately therefore does not save tenants a commission they would otherwise have owed.

Good to know

A real estate agent may only charge you a commission if he has looked for an apartment exclusively on your behalf. If someone demands money from you for an advertised apartment, this is not permitted.

02Where private landlords advertise in Düsseldorf

Private landlords primarily use portals with private filters and classified ads. However, many apartments are never advertised publicly, but are instead allocated through acquaintances, neighbors or notices.

  1. 1Portals with private filtersThe major real estate portals can be filtered by provider. Save a search with a notification - good offers are often gone after a few hours.
  2. 2Classifieds and noticesSupermarkets, bakeries, universities and church communities. Especially in districts like Wersten, Holthausen or Benrath, older owners like to rent to people in the neighborhood.
  3. 3Neighborhood networksOnline groups for individual districts and your own environment. Tell them that you are looking - recommendations are worth a lot with private landlords.
  4. 4Own requestA short, friendly request with a photo and key details reaches landlords who do not want to advertise themselves.

Alternative: Housing companies and cooperatives are not private landlords, but also offer commission-free rentals with checked agreements. With a low income, consider subsidised housing requiring a WBS.

03Own search: Check providers and rental data

This guide does not contain any current rental advertisements. You must check with the provider whether an offer really comes directly from the owner. Avoid advance payments and unnecessary sensitive documents to unverified recipients.

The Methodology explains the differences between data types and the limits of models. Asking rents show what landlords request, not necessarily what is ultimately agreed.

Choose several suitable areas and compare specific offers by total budget, condition and transport links. The Finding help for affordable housing explains how to distinguish rental-market data from your search budget.

04Is the rent fair? Check rent index and rent brake

Check the rent index to see whether the rent is appropriate. It gives the typical local comparative rent for apartments based on year of construction, size, location and furnishings. The rent control applies equally to private and commercial landlords - it only depends on the apartment, not the landlord.

  1. 1Determine comparative rentUse the apartment details with the information about the rent index from the city.
  2. 2Compare with the asking rentIn the area of the rent control, the rent for new rentals may be a maximum of 10% above the local reference rent (§ 556d BGB).
  3. 3Know exceptionsNew buildings, comprehensively modernized apartments and apartments whose previous rent was higher are completely or partially excluded. The landlord must inform you of this before the contract is concluded.
  4. 4Complain about rent being too highThe Tenancy law basics and comparative rent explains whether rent controls apply in Düsseldorf, for how long, and how to seek repayment of excessive rent.

First sign, then check?

Yes that works. You can also dispute the rent after you have moved in. Many tenants sign first to get the apartment. You can get help with the complaint from the Düsseldorf Tenants Association.

05Recognizing fraud: the typical scams

Fraud is more common with alleged private offers than with companies. The pattern is almost always the same: a nice apartment at a low price, a landlord who is currently abroad and a request for money before the viewing.

Warning signs when it comes to housing offers
ScamHow to recognize themYour step
Payment in advanceDeposit or first rent before inspection or contractnever pay
Key by mailLandlord abroad, key against payment via escrow or shipping servicecancel
Copy of ID in advanceID, bank statements or a SCHUFA report requested before initial contactonly after the viewing; redact the copy
Price too lowRent well below the rent index in a good locationCheck comparative rent
Contact only by emailno phone number, evasive answersRequest a telephone call and viewing

You should only hand over copies of ID after a real viewing. Black out the access number and photo and note “Copy for rental application at…”. If you have been cheated, report it to the Düsseldorf police and inform the portal.

A good test is a short phone call. Real landlords give their name, the exact address and a viewing date. Check whether the photos and description match the address and search for the pictures on the Internet: If they appear in other cities or holiday portals, the offer is fake. Only transfer the deposit to an account whose owner matches the landlord after the contract has been signed.

06Application folder for private landlords

Private landlords mainly want to know whether you will pay reliably and take care of the apartment. A complete, organised application helps you stand out.

  1. 1Short cover letterWho you are, why you're moving, who's moving in. A few personal sentences have more effect with private landlords than with companies.
  2. 2SCHUFA credit reportThe free data copy according to Art. 15 DSGVO is enough for many landlords. A paid credit report is not mandatory.
  3. 3Proof of incomeCurrent pay slips, tax assessment or BWA for self-employed people, a parental guarantee for students.
  4. 4Certificate of no rent arrearsFrom the previous landlord. The landlord does not have to issue them; Alternatively, bank statements provide evidence of punctual payment.
  5. 5Copy of ID cardOnly after the inspection, blacked out as described above.

Questions you do not have to answer

Questions about religion, party, pregnancy or family planning are not permitted. When providing self-disclosure, information that is important for the tenancy agreement is sufficient.

Bring the folder with you to the viewing in paper form and have a PDF file ready that you can send directly by email. Many private landlords decide within a few days. Those who send complete documents first and make a friendly, reliable impression often have the best chances - even against applicants with higher incomes. Be upfront if you have pets or want to work from home. This creates trust and saves arguments later.

07Rental agreement with a private landlord: what to look out for

The same tenancy law applies to private landlords as to companies. However, many use older forms. Therefore, read the contract carefully before you sign.

Deposit: The deposit may not exceed three monthly rents excluding operating costs (§ 551 BGB). You may pay it in three equal monthly instalments, starting at the beginning of the tenancy. The landlord must hold it separately from their own assets.

Graduated or index rent: With stepped rent, the agreement sets each increase; index-linked rent follows inflation. Neither allows additional increases up to comparative rent. Calculate what you would pay in five years.

Cosmetic repairs: Obligatory painting clauses are often ineffective, for example where deadlines are rigid or an unrenovated apartment was handed over without compensation. Record its condition with photographs at handover.

To register your residence at the Citizens' Office, you need a confirmation from the accommodation provider (Wohnungsgeberbestätigung). Ask the landlord to provide it with the contract. The tenants' association can help have unclear clauses checked.

08Privately let two-room apartments: opportunities by district

2-room apartments are in greatest demand in Düsseldorf: from singles, couples and commuters. In popular city center locations such as Pempelfort, Unterbilk or Flingern, a large number of interested parties quickly respond to an advertisement.

You have better chances in districts with many smaller, privately owned apartment buildings and slightly longer distances to the city center. These include Wersten, Holthausen, Hassels, Reisholz and Benrath in the south and Eller and Gerresheim in the east. Owners who live in the house or nearby often rent here.

  1. 1Expand search radiusOne more light rail stop can significantly reduce the number of competitors.
  2. 2Respond quicklyRespond same day with complete documentation.
  3. 3Come prepared for the viewingPaper folder included, questions about additional costs and heating prepared.

09Rent a house privately

Rental houses are rare in Düsseldorf and often come from private owners, for example following a move abroad or inheritance. Research in outlying areas such as Kaiserswerth, Angermund, Hubbelrath and Hellerhof. See Rent a house in Düsseldorf (research directly from suitable providers) for research routes.

When it comes to houses, it's worth taking a closer look at three points: Who takes care of the garden, winter service and minor repairs? Which operating costs are allocated, for example for property tax and building insurance? And is the contract limited because the owner wants to move in later? A fixed-term contract is only permitted for a reason stated in the contract.
