Questions

Frequently asked questions

F-01

Does the rent control apply throughout Düsseldorf?

The rent cap applies in municipalities that are listed in the NRW Tenant Protection Ordinance. The relevant version of the regulation at the time your rental begins is relevant.

F-02

What applies if my previous rent was higher?

If the previous tenant's rent was higher than the local comparative rent plus 10%, the landlord can generally continue to demand this previous rent (§ 556e BGB).

F-03

Can I claim back rent that I have paid too much?

A repayment claim requires a complaint to the landlord (section 556g BGB). If received within 30 months after the tenancy begins while it is still ongoing, it may also cover earlier overpayments. For a later complaint or a tenancy already ended, subsection 2 limits recovery to rent falling due afterwards. The contract date, exceptions and transitional rules must be checked separately.
