01The remaining debt is not the land register entry

The outstanding loan balance and the amount registered in the land register are different figures. Repaying the loan does not automatically cancel the land charge (Grundschuld). Check both the bank's current information and the actual land register entry. Do not use the registered land-charge amount as the remaining debt in the sell-or-rent calculator without checking it.

02What documents do you need for preparation?

Collect the land register extract, loan documents and the contacts at the bank holding the security. Clarify whether the land charge is registered only or accompanied by a certificate (Buchgrundschuld or Briefgrundschuld), and which documents are available. Identify missing records early. Agree with the bank and notary whether and how the charge will be repaid and cancelled as part of the specific sale; this page does not cancel it.

03Consent to cancellation and the land register procedure

Under § 875 BGB, cancelling a right in land generally requires the rights holder’s declaration and removal of the entry from the land register. Your own note that the loan is repaid does not replace these steps. The formal documents and procedure must fit the particular right. The notary can explain the required declarations and coordination with the bank.

04Don't estimate costs with a single percentage

Ask specifically which notary and land register steps are necessary and on what basis they are billed. Distinguish these costs from a possible prepayment penalty or an actual loan repayment. Only add proven amounts or amounts clearly stated as assumptions in your sales scenario. DDORF does not provide a guaranteed flat rate for every case.

05Coordinate before selling

Submit the complete land register status and bank contacts to the notary's office. Before making any commitments to buyers, clarify which charges will be assumed or deleted and how payments will be made. Do not allow old securities to be deleted without checking if there is still a financing purpose or another obligation. The appropriate procedure depends on the documents and the agreed processing.
