01Clarify ownership and scope of sale
Start with your purchase agreement, a suitable land register extract and the declaration of division, including the owners’ association rules. Clearly identify parking spaces, cellars and exclusive rights of use. A verbal statement such as “the garden comes with it” is not sufficient evidence. Ask the appointed notary which current documents the proposed arrangement requires. Inheritance, powers of attorney or multiple owners may require further evidence; our list does not replace those checks.
02Clearly document the floor plan, living space and condition
Compare the floor plan with the existing living-space calculation. Document differences, alterations and the source of the area figure; do not automatically treat the area stated in a listing as verified. Collect available construction records and renovation evidence. Record known damage and unresolved questions separately. Buyers should be able to distinguish documented information from points still to be clarified. Traceable property features are more useful for valuation than an unexplained price per square metre.
03Request WEG documents from the property management company
Request the current owners’ association budget, latest available annual accounts, asset report, and relevant meeting minutes and resolutions. § 28 WEG governs the budget, accounts and asset report, which includes the reserve balance. Major work already approved or under discussion also matters for your sale documents. A large reserve does not guarantee that no extra contribution will be required. Note each document’s year and outstanding questions about planned roof, facade or heating work.
04Document energy and rental separately
Check the building’s existing energy certificate. If it is missing or unsuitable, discuss issuing one with the responsible professional. For a sale, § 80 GModG requires presentation to prospective buyers no later than the viewing; special cases need separate assessment. For a rented apartment, gather the tenancy agreement and amendments, current basic rent, available statements and deposit details. Do not promise vacant possession until the actual situation has been legally clarified.
05A clear folder instead of uncontrolled sharing
Name files by subject and date, for example “WEG annual accounts 2025”. Keep a list of documents available, requested and still unresolved. A property brochure needs different information from a buyer’s, bank’s or notary’s review. Do not post complete land register records, signatures, bank details or neighbours’ information on an open website. Share required documents with authorised recipients in a controlled way. This guide does not ask you to upload your sale documents.
Frequently asked questions
Where can I get WEG documents?
Ask your property management about the existing documents and their status. Note which bills, reports or resolutions are still missing.
Does every apartment have to have the same complete list of documents?
No. Tenancies, alterations, special usage rights and the ownership situation affect which documents are needed. Agree the specific list with the notary and, where necessary, specialists.
